1. Who is Mandated to File GSTR-9 & GSTR-9C?
Form GSTR-9 is an annual return filed once for each financial year by all registered regular taxpayers. It consolidates monthly declarations made in GSTR-1 and GSTR-3B.
Exemptions by Turnover: Taxpayers whose aggregate annual turnover is up to ₹2 Crore are exempt from mandatory filing of GSTR-9. Taxpayers with aggregate turnover above ₹5 Crore must file both GSTR-9 and a self-certified reconciliation statement in Form GSTR-9C.
2. Table 8A vs GSTR-2B ITC Reconciliation
Table 8 of GSTR-9 compares total Input Tax Credit availed in GSTR-3B with figures auto-populated from vendor GSTR-1 filings in Table 8A. Any unexplained negative variance indicates excess ITC claimed, which must either be reversed or paid with Section 50 interest.
3. Voluntary Tax Payment via Form DRC-03
If annual reconciliation uncovers unpaid outward tax or ineligible ITC claimed, taxpayers can voluntarily pay the shortfall with interest through Form DRC-03 under the 'Annual Return' cause of payment before submitting GSTR-9, avoiding penal proceedings under Section 73 or 74.
4. Statutory Deadlines & Reduced Late Fee Caps
The statutory deadline for filing Form GSTR-9 and GSTR-9C is 31st December following the close of the financial year.
Under rationalized rules, for taxpayers with turnover up to ₹5 Crore, late fee is capped at ₹50 per day (₹25 CGST + ₹25 SGST) subject to a maximum of 0.04% of turnover (0.02% CGST + 0.02% SGST).
